Our client, a federal biologist, endured significant hardship in his role at a government agency due to his disability—deafness. Legal Grounds of the Case
The legal framework that governed this case was Section 501 of the Rehabilitation Act of 1973, which prohibits discrimination based on disability in federal employment. Additionally, the client’s case included elements of retaliation, a common issue in federal employment, where employees suffer adverse actions due to prior Equal Employment Opportunity (EEO) activity.
We argued that the denial of reasonable accommodations for our client’s disability was a clear violation of his rights under the Rehabilitation Act. Moreover, the termination and harassment he experienced were directly linked to his disability and his previous efforts to report workplace discrimination, which falls under protections offered by federal EEO laws.
The Resolution and Outcome
After a lengthy legal battle, which included an appeal to the Equal Employment Opportunity Commission (EEOC), Southworth PC successfully proved that our client had been discriminated against on the basis of his disability. The EEOC reversed the agency’s initial findings, ordering the agency to reinstate him to his position and provide compensatory damages for both the financial and emotional harm he suffered. While the initial five figure award in nonpecuniary damages was deemed insufficient by our team, we fought for an increase that better reflected the severity of our client’s suffering. Ultimately, the compensatory damages were raised to almost double the initial amount providing a more just outcome for the emotional and physical toll this experience took on him.
This case serves as a reminder that federal employees with disabilities have legal protections that should not be ignored.
